The operators of this site take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration.
Our website can usually be used without providing personal data. Insofar as personal data (e.g. name, address or email address) is collected on our website, this is always done on a voluntary basis as far as possible. These data will not be passed on to third parties without your explicit consent.
We would like to point out that data transmission via Internet (e.g. when communicating by email) can have security gaps. A complete protection of the data against access by third parties is not possible.
The function and communication of our service depends on the data of our users. Personal data are particularly sensitive - this means the processing of all information that is clearly related to one identified person or identifiable natural person, e.g. name, address, email addresses, user behavior.
A natural person is considered to be identifiable in case the person can be identified directly or according to an identification number, to location data, to an online identifier or to one or more special characteristics that express the physical, physiological, genetic, psychological, economic, cultural identity.
Processing is any process carried out with or without the help of automated procedures or any such series of processes in connection with personal data, such as the collection, recording, organization, ordering, storage, adaptation or change, reading, querying, use, disclosure by transmission, distribution or any other form of provision, comparison or linking, restriction, deletion or destruction.
The restriction of processing is the marking of stored personal data with the aim of restricting its future processing.
According to the GDPR, there is an obligation to list the entire scope of all such data.
By sending electronic notifications, the following personal data may be collected in accordance with the GDPR:
• First and Last Name
• Address
• Telephone number
• Fax
• Mobile phone number
• E-mail address
• IP address
This data may also be processed if you send a fax to MAX LODGING or transmit your data by telephone.
We assure you that this data is used exclusively for the functioning, statistical evaluation and improvement of our offer. According to the applicable regulations, this data is only collected for the time you are using our service. The legally applicable deletion regulations are complied with.
The MAX LODGING website collects a series of general data and information about your device every time the website is accessed by a person or an automated system. These general data and information is transmitted from your browser to our server and stored on the server as log files.
The browser types and versions used as well as the language of the browser software, the operating system used by the accessing system and its interface, the website from which an accessing system reaches our website (previous page, hyperlink, etc.), the sub-websites via an accessing system on our website is controlled, the date, time and frequency of access to the website, an internet protocol address (IP address),
the Internet service provider of the accessing system, the time zone difference to Greenwich Mean Time (GMT), the access status / http status code, the amount of data sent and other similar data and information that can be used to avert danger in the event of attacks on our information technology systems to serve.
This data is collected when you use our website for informational purposes only, i.e. when you do not provide us with any other information.
When using these general data and information, MAX LODGING does not draw any conclusions about the person concerned.
Rather, this information is required (the legal basis is Art. 6 Para. 1 S. 1 lit.f GDPR) in order to correctly deliver the content of our website, to optimize the content of our website, to guarantee the long-term functionality of our information technology systems and the technology of our website and to provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack.
This anonymously collected data and information is therefore statistically evaluated by MAX LODGING on the one hand and with the aim of increasing data protection and data security in our company; on the other hand, in order to ultimately ensure an optimal level of protection for the personal data processed by us. The anonymous data in the server log files are stored separately from all personal data provided by a person.
The operator may only save, issue or subsequently access server log files for a longer period if this is permitted within the legal framework (e.g. if illegal activities are suspected).
If you send us inquiries using the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the request and in case of follow-up questions. We do not pass on this data without your consent.
Legal or contractual provisions for the provision of personal data; Necessity for the conclusion of the contract; Obligation of users to provide the personal data; possible consequences of non-provision
MAX LODGING informs you that the provision of personal data is partly required by law (e.g. tax regulations) or that it may result from contractual regulations (e.g. information on the contractual partner). In order to conclude a contract, it may sometimes be necessary for a user to provide us with personal data that we subsequently have to process. For example, the user is obliged to provide us with personal data when our company concludes a contract with them. Failure to provide personal data would mean that the contract could not be concluded with the person concerned.
Some of the websites use so-called cookies. Cookies do not harm your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, more effective and safer. Cookies are small text files that are stored on your computer and saved by your browser. Most of the cookies we use are so-called "session cookies". They are automatically deleted after your visit. Other cookies remain on your device until you delete them. These cookies enable us to recognize your browser the next time you visit our website.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or generally, and activate the automatic deletion of cookies when you close the browser. If cookies are deactivated, the functionality of this website may be restricted.
Advertising cookies
Advertising cookies are cookies that are used to better tailor advertising to the interests of the user. They remind the user that they have already visited a website. They are often linked to the functionality of the website. We use these cookies to analyze your browser behavior and thus to be able to offer you relevant advertising that corresponds to your interests.
As already mentioned, you can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when you close the browser. If cookies are deactivated, the functionality of this website may be restricted.
Customized advertising
If you have activated cookies in your browser, we will present advertising messages relating to our website. Google and third-party providers show our advertising messages on several websites. If you have activated cookies in your browser, you can see advertising messages for this website on other websites. If you would like to unsubscribe from the "customized advertising" service, you will be asked to visit the Network Advertising page at www.networkadvertising.org/choices/, where you can sign out.
This website uses functions of the web analysis service Google Analytics. The provider is Google Inc. 1600 Amphitheater Parkway Mountain View, CA 94043, USA. Web analysis is the gathering, collection and evaluation of data on the behavior of visitors to websites. A web analysis service collects, among other things, data on the website from which a person came to a website, which subpages of the website were accessed or how often and for how long a subpage was viewed.
Google Analytics uses so-called "cookies". These are text files that are saved on your computer and that enable an analysis of your use of the website.
The cookie gives Google knowledge of the user's personal data. The personal information, for example the access time, the location (the previously visited website) from which access originated, the type of browser and its version, the IP address and the frequency of visits to our website by the user, are recorded. Each time you visit our website, the Cookie-generated personal information about your use of this website is usually transferred to a Google server in the USA and stored there. Google may pass this personal data collected through the technical process on to third parties.
However, if IP anonymization is activated on this website, your IP address will prior be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. The full IP address is only transmitted to a Google server in the USA and shortened there in exceptional cases. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with other services relating to website activity and internet usage.
The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
You can prevent the storage of cookies by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs.
You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by downloading the browser plug-in available under the following link and install: http://tools.google.com/dlpage/gaoptout?hl=de
This browser add-on informs Google Analytics that no data or information on website visits may be transmitted to Google Analytics. The installation of the browser add-on is considered an objection by Google. If the information technology system of the user is deleted, formatted or reinstalled at a later date, the user must reinstall the browser add-on in order to deactivate Google Analytics.
Further information and the applicable data protection provisions of Google can be found at www.google.de/intl/de/policies/privacy/ and at www.google.com/analytics/terms/de.html. Google Analytics is explained in more detail under this link www.google.com/intl/de_de/analytics/.
Data protection declaration for the use of Google AdWords
Google AdWords has been integrated into this website. Google AdWords is an internet advertising service that allows advertisers to place advertisements in Google's search engine results as well as in the Google advertising network. Google AdWords enables an advertiser to define certain keywords in advance by means of which an advertisement is only displayed in Google's search engine results if the user calls up a keyword-relevant search result with the search engine. The operating company for the services of Google AdWords is Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043-1351, USA.
The purpose of Google AdWords is to promote our website by displaying interest-relevant advertising on the websites of third-party companies, the search engine results of the Google search engine and by displaying third-party advertising on our website.
If a person reaches our website via a Google ad, a so-called conversion cookie is stored on the information technology system of the user by Google. A conversion cookie loses its validity after thirty days and is not used to identify the user. If the cookie has not yet expired, the conversion cookie is used to determine whether certain sub-pages have been accessed on our website.
The data and information collected through the use of the conversion cookie are used by Google to compile visit statistics for our website. These visit statistics are in turn used by us to determine the total number of users who were referred to us via AdWords advertisements, i.e. to determine the success or failure of the respective AdWords advertisement and to optimize our AdWords advertisements for the future.
Neither our company nor other Google AdWords advertisers receive any information from Google that could be used to identify users.
The conversion cookie is used to store personal information, such as the websites visited by the user. Each time you visit our website, personal data, including the IP address of the Internet connection used by the visitor, is transmitted to and stored by Google in the United States of America. Google may pass this personal data collected through the technical process on to third parties.
The user can prevent the setting of cookies by our website at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the internet browser used would also prevent Google from setting a conversion cookie on the information technology system of the user. In addition, a cookie already set by Google AdWords can be deleted at any time via the Internet browser or other software programs.
Furthermore, the user has the option of objecting to interest-based advertising by Google. To do this, the user must call up the link www.google.de/settings/ads from each of the internet browsers used and make the desired settings there.
Further information and the applicable data protection provisions of Google can be found at www.google.de/intl/de/policies/privacy/.
In addition to Google Adwords, we use the Google Remarketing application. This is a process that we would like to use to address you again. This application allows you to see our advertisements when you continue to use the internet after visiting our website. This is done by means of cookies stored in your browser, which are used by Google to record and evaluate your usage behavior when you visit various websites. In this way, Google can determine your previous visit to our website. A merging of the data collected in the context of remarketing with your personal data, which may be stored by Google, does not take place by Google according to its own statements. In particular, according to Google, pseudonymization is used in remarketing.

MAX LODGING collects and processes the personal data of applicants for the purpose of handling the application process. The processing can also be done electronically. This is particularly the case if an applicant sends corresponding application documents to MAX LODGING electronically, for example by email. If MAX LODGING concludes an employment contract with an applicant, the data transmitted will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If MAX LODGING does not conclude an employment contract with the applicant, the application documents will be deleted after the legally permissible retention period has expired, provided that deletion does not conflict with any other legitimate interests of MAX LODGING. Another legitimate interest in this sense is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).
The house entrances are video-monitored for the safety of residents and visitors (protection of property and physical integrity) (legal basis is Art. 6 Para. 1 S. 1 lit. F. GDPR). The video surveillance serves to prevent break-ins, theft and vandalism, as well as to preserve evidence after offenses committed.
The personal data will be deleted immediately if they are no longer necessary to achieve the purposes for which they were collected (Art. 17 Para. 1 lit. A GDPR) or if the interests of the data subject prevent further storage. Deletion takes place after 48 hours.
MAX LODGING processes and stores personal data of users only for the period necessary to achieve the storage purpose or if this has been provided for by the European directives and regulations or another legislator in laws or regulations to which the website operator is subject.
If the purpose of storage no longer applies or if a storage period prescribed by the European directives and regulations or another responsible legislator expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.
In some cases, we use external service providers (in particular IT service providers) to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are checked regularly.
We assure you that the data passed on meet the legal requirements and that data is only sent to or can be viewed by these departments.
MAX LODGING does not pass your data on to unrelated third parties.
In addition, we use appropriate measures and regular controls to ensure that the data we collect cannot be viewed or tapped from outside by third parties.
Right to confirmation
You have the right to request confirmation whether your personal data is being processed and, if it is being processed, to check it.
Right to rectification or completion
You have the right to correct your data or to have it completed, also by means of a supplementary statement, taking into account the purposes of the processing, by sending us an email to service@max-lodging.de.
Right not to be subject to automated decisions in individual cases including profiling
You have the right not to be subject to a decision based solely on automated processing - including profiling - which has legal effect on you or which significantly affects you in a similar manner, provided that the decision
- is not necessary for the conclusion or fulfillment of a contract with us, or
- is permissible on the basis of legal provisions of the Union or of the member states to which MAX LODGING is subject and these legal provisions contain appropriate measures to safeguard the rights and freedoms as well as the legitimate interests of the user concerned
or
- takes place with the explicit consent of the user concerned.
Profiling is any type of automated processing of personal data that consists of using this personal data to evaluate certain personal aspects that relate to a natural person, in particular aspects relating to work performance, economic situation, health, to analyze or predict the personal preferences, interests, reliability, behavior, abode or change of location of this natural person.
If the decision is necessary to conclude or fulfill a contract between the user concerned and MAX LODGING or if it is made with the explicit consent of the user concerned, MAX LODGING will take appropriate measures to protect the rights and freedoms and legitimate interests of the user concerned. This includes at least the right to obtain the intervention of a person on the part of MAX LODGING, to present one's own point of view and the opposition of the recognition of the decision.
Right to information
You have the right to receive information about the personal data stored about you and a copy of this information. You also have a right to information about the following:
• information about the purpose of processing
• information about the categories personal data are processed

• If possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration
• the existence of a right to correction or deletion of the personal data concerning you
or restriction of processing by MAX LODGING or a right to object to this processing
• the existence of a right to lodge a complaint with a supervisory authority
• if the personal data were not collected from you: all available information about the origin of the data

• Transfer of personal data to a third country or to an international organization as well as the right to information about the appropriate guarantees in connection with the transfer

You have the right to receive the personal data concerning you in a structured, common and machine-readable format. You also have the right to transfer this data to another body, provided that the processing is based on the consent of the user concerned in accordance with Article 6 (1) (a) GDPR or Article 9 (2) (a) GDPR or on a contract in accordance with Art. 6 Para. 1 lit.b GDPR and the processing is carried out with the aid of automated procedures, unless the processing is necessary for the performance of a task that is in the public interest or takes place in the exercise of official authority that was delegated to MAX LODGING.
In accordance with Art. 20 (1) GDPR, you also have the right to request that your data be transferred from us to another body, provided this is technically feasible and provided that this does not impair the rights and freedoms of other people.
Right to object
For reasons that arise from your particular situation, you have the right to object at any time to the processing of your personal data, which is based on Art. 6 Para. 1 e) or f) GDPR.
This also applies to profiling based on these provisions.
When exercising your right, please also explain the reasons why we should not process your personal data as we have done.
MAX LODGING will no longer process the personal data in the event of an objection, unless we can prove compelling legitimate reasons for the processing that outweigh the interests, rights and freedoms of the user, or the processing serves to assert, exercise or defend legal claims .
If MAX LODGING processes personal data in order to operate direct mail, the user concerned has the right to object at any time to the processing of personal data for the purpose of such advertising. This also applies to profiling insofar as it is related to such direct mail. If the user concerned objects to MAX LODGING processing for direct marketing purposes, MAX LODGING will no longer process the personal data for these purposes.
In addition, the user concerned has the right, for reasons arising from his or her particular situation, to object to the processing of personal data concerning him, which is carried out at MAX LODGING for scientific or historical research purposes or for statistical purposes in accordance with Art. 89 Para. 1 GDPR, to object, unless such processing is necessary to fulfill a task in the public interest.
Right to restriction of processing
You have the right to request that processing is restricted if one of the following conditions is met:
• The accuracy of the personal data is contested by the user concerned, for a period that enables us to check the accuracy of the personal data.
• The processing is unlawful, the user concerned refuses to delete the personal data and instead requests that the use of the personal data be restricted.
• The personal data is no longer required for the purposes of processing, but the user concerned needs them to assert, exercise or defend legal claims.
• The user concerned has lodged an objection to the processing in accordance with Article 21 Paragraph 1 GDPR and it has not yet been determined whether the legitimate reasons of MAX LODGING outweigh those of the user concerned.

You have the right to have your personal data deleted if one of the following reasons applies and if processing is not necessary:
• the personal data was collected or otherwise processed for purposes for which they are no longer necessary.

• The personal data was processed unlawfully.
• The deletion of personal data is necessary to fulfill a legal obligation under Union law or the law of the member states to which MAX LODGING is subject
• The personal data was collected in relation to the services offered by MAX LODGING in accordance with Art. 8 Para. 1 GDPR.
If the personal data has been made public by MAX LODGING and our company is obliged to delete the personal data in accordance with Art. 17 Paragraph 1 GDPR, MAX LODGING takes appropriate measures, including technical measures, to prevent others, taking into account the available technology and the implementation costs to inform those responsible for data processing who process the published personal data that the user has requested, the deletion of all links from these other responsible persons for data processing has requested for this personal data or for copies or replications of this personal data, insofar as the processing is not necessary.
Right of appeal
You have the right to lodge a complaint with a supervisory authority or a competent body if you have a reason for complaint.
To exercise these rights, please contact the responsible contact person listed at the end of this data protection declaration.
You can contact us at any time at the address given in the legal notice if you have any further questions on the subject of personal data.
Contradiction advertising mails
We hereby object to the use of the contact data published as part of the imprint obligation for sending unsolicited advertising and information materials. The operators of the pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, such as spam emails.
Legal basis for processing
Art. 6 (1) (a) GDPR serves MAX LODGING as the legal basis for processing operations for which we obtain consent for a specific processing purpose.
If the processing of personal data is necessary for the fulfillment of a contract to which the user concerned is a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or other objects or the provision of other services or consideration processing is based on Art. 6 Para. 1 lit. b GDPR. The same applies to processing operations that are necessary to carry out pre-contractual measures, for example in cases of inquiries about our services.
If MAX LODGING is subject to a legal obligation that requires the processing of personal data, for example to fulfill tax obligations, the processing is based on Art. 6 Paragraph 1 lit. c GDPR.
In rare cases, it may be necessary to process personal data in order to protect the vital interests of the user concerned or of another natural person. This would be the case, for example, if a visitor to our company were injured and his name, age, health insurance data or other vital information would have to be passed on to a doctor, hospital or other third party. The processing would then be based on Article 6 (1) (d) GDPR.
Ultimately, processing operations could be based on Article 6 (1) (f) GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to safeguard a legitimate interest of MAX LODGING or a third party, provided that the interests of the data subject do not outweigh the fundamental rights and freedoms.
We are particularly permitted to carry out such processing operations because they have been specifically mentioned by the European legislator. In this respect, he took the view that a legitimate interest could be assumed if the user concerned is a MAX LODGING customer (recital 47 sentence 2 GDPR).
Legitimate interests in processing pursued by MAX LODGING or a third party
If the processing of personal data is based on Article 6 (1) (f) GDPR, our legitimate interest is to conduct our business activities for the benefit of all of our employees.

It can happen that third party content, such as videos from YouTube, maps from Google Maps, RSS feeds or graphics from other websites, are integrated into this online offer. This always presupposes that the providers of this content (hereinafter referred to as "third-party providers") perceive the IP address of the user, because without the IP address, they could not send the content to the browser of the respective user. The address is therefore necessary for the presentation of this content. We strive to only use content whose respective provider only uses the IP address to deliver the content. However, we have no influence on whether the third party provider uses the IP address, for example Store for statistical purposes. As far as we know, we will inform users about it.
- Integration of YouTube videos
When you play the videos on our website, YouTube receives the information that you have accessed the corresponding subpage of our website. Your IP address is also sent regularly. In the case of YouTube, the IP address is transmitted to Google Inc., 600 Amphitheater Parkway, Mountain View, CA 94043, USA (“Google”). The general data mentioned in this declaration will also be transmitted. We have no influence on this data transfer.
This takes place regardless of whether YouTube provides a user account that you are logged in to or whether there is no user account. If you are logged in to Google, your data will be assigned directly to your account. If you do not want the assignment to your profile on YouTube, you must log out before activating the button. YouTube stores your data as a usage profile and uses it for advertising, market research and / or needs-based design of its website. Such an evaluation takes place in particular (even for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, although you must contact YouTube to exercise this right.
Further information on the purpose and scope of data collection and its processing by YouTube can be found in the provider's privacy policy. There you will also find further information on your rights and setting options to protect your privacy: www.google.de/intl/de/policies/privacy. Google also processes your personal data in the USA and has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.
- Integration of Google Maps
With Google Maps we can show you interactive maps directly on the website and enable you to conveniently use the map function.
When you visit the website, Google receives the information that you have accessed the corresponding subpage of our website. The general data mentioned in this declaration will also be transmitted. We have no influence on this data transfer.
This happens regardless of whether Google provides a user account that you are logged in to or whether there is no user account. If you are logged in to Google, your data will be assigned directly to your account. If you do not want the assignment to your profile on Google, you must log out before activating the button. Google stores your data as a user profile and uses it for advertising, market research and / or needs-based design of its website. Such an evaluation takes place in particular (even for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our website.
You have the right to object to the creation of these user profiles, although you must contact Google to exercise this right.
Further information on the purpose and scope of the data collection and its processing by the plug-in provider can be found in the provider's privacy policy. There you will also find further information on your rights in this regard and setting options to protect your privacy: www.google.de/intl/de/policies/privacy. Google also processes your personal data in the USA and has submitted to the EU-US Privacy Shield, www.privacyshield.gov/EU-US-Framework.
