The penthouse is spread over 2 floors. On the entrance level are the 3 separate bedrooms; all equipped with flatscreen TV, large double box spring bed, spacious built-in furniture.
One bedroom even has a bathroom en suite (double vanity, shower and free-standing bath).

All rooms have access to the spacious roof terrace with dining and lounging area.

Inside, a staircase leads to the upper floor. Here you will find a spacious living / kitchen / dining area. Due to the surrounding window front, the room is always flooded with natural light.
The blinds on the exterior glazing are electronically controllable. The entire room is air conditioned.

The high-quality equipped and fitted kitchen offers enough space to cook for the whole family or friends. The kitchen is exclusively equipped with high quality brand appliances. Among other things, you will find a fully automatic coffee machine integrated in the front and a separate wine cooler. A large dining table with 8 chairs invites you to cozy evenings. The bathrooms are equipped with walk-in showers, toilet and vanity. a large, bright en suite bathroom also offers a roll top bath. The kitchenette is fully equipped. Modern branded appliances such as induction cooker (4 burners), retractable extractor fan, oven with microwave function, dishwasher, refrigerator with freezer, wine cooler and an integrated coffee machine leave nothing to be desired. Each of the 3 bedrooms on the entrance level has its own flat screen TV. The rooms feature floor-to-ceiling windows and a beautiful parquet floor. The light-flooded rooms are warm and comfortable. A mandatory intermediate cleaning takes place once a month.

Additional intermediate cleaning can be booked on request at any time.

In the intermediate cleaning floors are vacuumed and wiped, kitchen surfaces are cleaned, tables and countertops wiped, trash emptied and  the bathrooms cleaned. We offer intermediate cleaning at 250 € per cleaning. The final cleaning fee is 450 €.
The final cleaning is mandatory.

A Miele washing machine and a Miele dryer are located in the penthouse.

MAX LODGING offers its own underground parking space for its penthouse guests.

The parking space has an electric charging station for electric vehicles.

Usage and house rules

These house rules should primarily serve to achieve a good atmosphere and a compatible coexistence of all residents of the house Leutascher Straße 9, 81373 Munich. Therefore, the principle of consideration, courtesy, understanding for each other and punctuality applies in principle. Tolerance and nonviolence are principles of our house. All will only feel well if the customers of MAX LODGING stick to it.

Once in force next to the following provisions the house rules of Home Owner Community Leutascher Straße 9, 81373 Munich are also valid.


Care and due diligence

The entrance doors must always be closed. The access to the garage has to be kept free.

The drainage pipes - especially the bathroom, kitchen and toilet - must not be used to dispose of waste, food scraps, fats or other objects that could block the sewage system. These items belong in the designated waste container or in the hazardous waste. (further information see "garbage")


The storage of toxic or combustible materials in the apartment, underground car park and in the basement rooms including the corridors is not permitted



As far as it is recognizable and ascertainable for the resident, he will inform the staff of MAX LODGING as soon as possible about damage in the apartment or in the common areas.

All common areas and the staircase must be kept clean and tidy.

Windows and patio doors should be closed during rain or storm. External venetian blinds are to be raised in strong wind.

In the absence of all lights are to be turned off. (also the terrace lighting)

Animals are not allowed.


Rest periods

Every resident must behave in such a way that other residents are not disturbed by noise, music.

Especially on Sundays and public holidays, as well as on weekdays between 12 am and 2 pm and 10 pm and 8 am noise, which penetrates outside the own flat, has to be avoided. At this time, making music is forbidden.

The official regulations are to be observed.

Outdoor facilities / playground

The playground can be used by all residents of the house. Here, especially in the given rest periods no noise should be caused. The playground equipment, the sandpit and all outdoor facilities are to be treated with care.


The apartment is a NON SMOKING Apartment .
Should this be violated, MAX LODGING reserves the right to charge a 2.000 euro cleaning fee.



The resident is obliged to regularly empty the garbage pins in the apartment and to dispose it in the designated waste container in front of the house.


Exact instructions for waste disposal - and separation are handed out. (black bin = residual waste, blue bin = paper and cardboard, brown bin = organic waste)


The waste must be disposed in the barrels and not be put in front.


It is also prohibited to throw objects, garbage or the like from the roof terrace.



Stairwell, and basement corridors and common areas

In the staircase and in the basement corridors no bicycles or baby carriages may be parked.


The barbecue on the terrace surfaces is only allowed with an electric table grill. The use of coal and gas grills is prohibited.


Generally, building, inventory, facilities and community facilities are to be treated with care. Damage, defects or necessary repairs must be reported to MAX LODGING immediately. The apartment must be kept in a very good condition.



Should occur any gross violation of the house rules, MAX LODGING reserves the right to terminate the contract with the resident without notice and block the access to the apartment.

A loss of one or more keys must be reported to MAX LODGING immediately.

    The premises and the inventory are to be treated with care and kept up to date. 
A weekly cleaning is recommended
. For cleaning the kitchen countertops, the
parquet and the coffee machine, only the cleaning agents provided by MAX
    LODGING are to be used. (Briefing at apartment handover)


2.      Stains on wooden parts and on the parquet are always to be removed immediately.

3.      The apartment may only be entered with soft slippers, but not with street shoes, shoes with heels and shoes with a discoloring sole.    

4.      The access to the apartment is permitted to MAX LODGING staff as well as the staff assigned by MAX LODGING  for the following purposes:

·         monthly inspektion

·          monthly cleaning

·         repair and maintenance work

·         Visits with future prospective tenants

5.      If the weather is appropriate it is mandatory to:

·         to water the balcony plants accordingly

·         retract the roof of the terrace pavilion

·         Obtain the upholstery of the patio furniture

·         Make sure windows, skylights and patio doors are closed

6.      For damage resulting from improper conduct or from non-compliance with the terms of use, the renter is fully liable In case of improper use and misconduct of the resident, the provider is entitled to charge a deposit of 3 times the monthly rent of the deposited credit card after prior notification.

General Business Terms

1. Definition of Terms

1.1       Provider
Provider is MAX LODGING - Alexandra Griesinger


1.2    Customer, Renter, Visitor
Customer/renter  is the contracting party (the natural or legal person or company in whose name the rental is made), the user (the person entitled to use the leased apartment) Visitors are persons acting on behalf of the customer, with his / her intervention or his will come into contact with the offered apartment.


1.3       Penthouse / apartment
The object that is offered by the provider to the contracting party for a fee. In the following called "Penthouse". Address: Leutascher Straße 9, 81373 Munich

2. Scope

2.1       The terms and conditions apply to all contracts and reservation agreements for the lease of the penthouse on time and for all other services provided by the provider. The transfer takes place for temporary use within the meaning of § 549 II No. 1 BGB.

2.2       The leased penthouse may not be made available to third parties (that is, to unauthorized persons). Excepted from this is the temporary visit which the contracting party or the authorized person receives. Furthermore, the use for other than for residential purposes is not allowed.

2.3       Deviating provisions shall not apply without the express written approval of the provider.

2.4       Terms and conditions of the contractor will not apply.


3. Contract conclusion, representation

3.1       Adoption
            The contract is concluded when
- the provider confirms the reservation request of the contracting partner or his representative in
            writing by mail, e-mail and / or fax or
            - sending the reservation agreement and at the same time the first advance payment or the total
            amount to be paid in advance is received in time on one of the provider's bank accounts



3.2       In case several persons have signed the contract, they give each other authority,
to make and accept all statements and acts under the reservation agreement for each other.
Facts that occur in the person or behavior of one of the joint debtors work for and
against all.

If the person entitled to use is not at the same time the contracting party, the contracting party grants the authorized person power of attorney to make all declarations and legal acts in the context of the reservation agreement as representative of the contracting party


            All declarations and legal acts in the context of the reservation agreement consequently act for and against the contracting party.

3.3       Correctness of the contract

            The contracting party is obliged to check the reservation confirmation for correctness. If this confirmation differs from the reservation request in terms of content and if the contracting party does not object to this within 48 hours, the content of the confirmation shall be deemed agreed.


3.4.          With receipt of payment of the first advance payment or advance payment of total amount, the 
reservation for the agreed period for the provider is binding. If the provider terminates the contract
               in the event of late payment, the cancellation fees indicated in MAX LODGING-GBTs (see 9.3).


4. Price / Service

4.1       The penthouse is provided by the provider from a minimum rental period of 3 months

4.2       The provider is obliged to keep ready the penthouse apartment reserved for the contracting party.

4.3       The contracting party is obliged to pay the applicable or agreed prices of the provider for the provision of the penthouse apartment and for the other services used by him. This also applies to the contractor's services and expenses of the provider to third parties.

4.4       Additional services are not included in the rental price and must be paid in advance.

4.5       The prices of the agreed service can be found in the reservation confirmation. In addition, the provider refers to the description of the equipment and services on his homepage


4.6     All prices include the applicable VAT valid for the period of stay. If VAT tax value
changes during the period of stay, this will be calculated pro rata for the respective period.
               The contracting party commits itself in the case of a change of the legal value added tax to pay the
               prices adapted by the offerer to this change.


4.7       The contracting party is obliged to provide truthful information about the number of persons occupying the penthouse apartment. The penthouse apartment is available for a maximum of the number of persons stated in the reservation agreement. The occupancy of an additional number of persons requires the prior written consent of the provider. The price for the lease of the apartment increases in this case on the basis of appropriate occupancy by the provider generally calculated price. This is listed on the homepage or refer to the individual offer from the provider.

5. Reservation and payment


5.1       Reservation
If the customer reserves the apartment by phone or in writing, he will receive a written confirmation of the reservation. This must be checked by the customer upon receipt for accuracy.


The invoice must be paid in monthly partial payments in accordance with the attached payment plan at the relevant date in cash, by debit card or by credit card (Master, Visa or American Express) or by bank transfer. In this case, the rate must be credited in advance to the date specified in the payment schedule to the account of the provider. Otherwise, the provider reserves the right to deny access to the apartment.

5.3       The contracting party expressly agrees that the provider is entitled to invoice the contracting party for any outstanding claims that were not paid by the time of the move-out date. The claims include demands of the provider, which were caused by persons who come into contact with the offered apartment with interference of the contracting party.
The contracting party commits to pay the invoice in accordance with the payment plan upon receipt without deductions within the specified payment period.

5.4       A default of payment entitles the provider to terminate the contract according to the following provisions. In such cases, he has the right to refuse further services and access.

5.5       The place of fulfillment for all payment obligations is the operating location of the provider, which is at the same time the location of the rented.

5.6       It is not possible to reimburse the contractually agreed services that were not used by the contracting party or the authorized persons


6          Move-in and move-out, key collection, late leaving, extension by several days, deposit         



6.1       The penthouse apartment can be moved into on the day of arrival at 3 pm. An earlier check-in can only be made if this has been agreed in advance with the provider.


6.2       The contracting party is obliged to provide the supplier his / her valid identity card or passport upon arrival. Also credit card data of the contracting party are to be deposited to the supplier.


6.3     On the day of moving in, the apartment will be inspected and handed over together with renter and 
supplier. Any defects shall be written down by MAX LODGING personnel and the following keys
               will be handed over against signature of the contracting partner or the authorized resident in


               substitution of the contracting party:




               2 apartment keys


               2 front door keys (also closing underground garage door and gate)


               2 mailbox keys


A key loss is to be reported to MAX LODGING immediately. 
The resulting costs, including the procurement of a new key, shall paid by the contracting party:
The contractual partner or the authorized occupant is instructed by the MAX LODGING personnel in the handling of the devices in the apartment and the house rules.


The handover protocol must be signed by the provider and the contracting party or the authorized occupant upon handover. A copy of the valid house rules will be handed over. Their observance is obligatory for the contracting party as well as for the entitled residents.


6.4       On the day of departure, the penthouse apartment must be vacated by 12:00 am at the latest. The MAX LODGING staff will arrive at 10:00 am on the day of departure for approval of the apartment. All defects and damage to inventory, walls, ceilings, floors, stairs and the terrace area, etc. are logged. If damages are found, the provider can charge up to 3 months rent deposit until the actual determination and payment of the amount of damage. The amount can be charged to the credit card deposited. A settlement of the actual amount of damage with the respective deposit amount is possible. The apartment has to be handed over swept by the renter. Waste must be disposed of by the renter



according to waste separation.
The handover protocol must be signed by the MAX LODGING personnel and the contracting party or in its representation by the authorized occupant.
Any outstanding claims must be settled by this time at the latest.
Inquiries for an extension of the rental are to be addressed in time to the provider
Here, the respective opening times of the office are to be considered. An extension of the renting is only possible against payment in advance. In case the apartment is used after 12:00 am on the departure day, a complete additional daily rate plus a surcharge of 25% of the daily rate will be charged.


6.5       The penthouse apartment has to be handed over by the inhabitant in the same condition as upon move-in. The contracting party is liable to the provider for damage and excessive pollution inside and outside the apartment which he or another person, who has come into contact with, is responsible for.

6.6       The reservation can be extended according to availability.

6.7       The extension is only valid after signing the new reservation agreement and payment.

Terms of use / data protection, access rights, deposit entitlement

7.1       The contract partner or resident lives in the apartment for a limited period of time and has his / her center of life here during this period. The apartment may only be used for residential purposes. Tourist use and stays for medical reasons are not allowed.

7.2       The subletting or other transfer of use of the apartment to other, than on the reservation agreement and the registration form specified persons is prohibited.


7.3    The contracting party or resident must treat the apartment and the interior in it cleanly and with 
care and has to dispose any waste according to the waste separation data in the garbage cans in front of the house
. The surfaces or floor surfaces (such as parquet etc.) are to be cleaned with the cleaning agents provided by MAX LODGING only (see also terms of use).
In case of improper use and misconduct of the resident, the provider is entitled to charge a deposit of 3 times the monthly rent of the deposited credit card after prior notification.


7.4       The terms of use are part of the terms and conditions

7.5       Animal husbandry is not permitted for hygienic reasons.


7.6     Smoking in the apartment is prohibited.
If smoking is still done in the apartment, an additional cleaning fee of at least 2000, - € will be
               charged. Smoking is only allowed on the roof terrace with the doors closed. Appropriate containers
for disposal must be used.


7.7       Each contracting party is obliged to comply with the house rules. This is part of the terms and conditions and can be viewed in the office. From 10 pm till 7 am is night’s rest. In this time special attention has to be paid to the neighbors also in the house entrances and staircases. To avoid any interference, TV and audio equipment should always be set to low volume.

7.8       If the provider is obstructed by force majeure or strike in the performance of his services, no liability for damages can be derived from this.

7.9       Insofar as the provider procures external services, technical or other equipment from third parties for the contracting party, he acts in the name and for the account of the contracting party. The contracting party is liable for the careful handling and proper, complete return of the equipment and indemnifies the supplier from all claims of third parties from the transfer of this equipment (s).

7.10      The provider and / or his agents have access rights to the apartment at any time. In the exercise of the right of access the legitimate concerns of the contracting party have to be respected. The provider will inform the contracting party in advance of the exercise of the access right, unless this is not reasonable or possible in the circumstances of the individual case.
Cleaning and service personnel are permitted to enter the apartment during normal working and daytime hours for cleaning and repair purposes.


7.11     To control the proper condition of the penthouse and the terraces, MAX LODGING is entitled to 
inspect the apartment. This is done after informing the inhabitant in advance. Access to the
apartment is to be granted for this.
               If damages are found, the provider can charge up to 3 months rent
deposit until the actual determination and settlement of the amount of
               damage on the deposited credit card. A settlement of the actual amount
               of damage with the respective deposit amount is possible.


7.12      MAX LODGING is permitted to conduct surveys with prospective tenants upon prior notice.

7.13      The personal data collected by the contracting party are stored electronically by the provider. The data will not be passed on to third parties, unless this is necessary for the execution of the contract. The detailed privacy policy can be viewed on the provider's website.



8. Termination by the Provider



8.1       If the contracting party grossly disregards the terms of use, the provider may demand the immediate eviction of the apartment after termination without notice. The claim for payment of the agreed rental price remains in full as a claim for damages of the provider.

8.2       The provider is entitled to cancel the contract for objectively justifiable reasons, without notice (even before handing over the apartment), for example if

    • force majeure or other circumstances for which the provider is not responsible make fulfillment of the contract impossible;
    • the apartment was rented under misleading facts, e.g. in the person of the customer or the purpose it was reserved for
    • the provider has a reasonable cause to believe that the use of the services might jeopardize the smooth operation of its business, or the safety or the public reputation of the facility, in ways not attributable to the provider's own management or organization.
    • there is a violation of these terms and conditions.
    • The use is prohibited by the authorities, for whatever reason
    • the contracting party is in default of payment of the rent in the amount of at least half of the monthly rent in accordance with § 543 paragraph 2 no. 3 BGB.

8.3       The Provider shall also be entitled to terminate the contractual relationship on the third working day of a calendar month at the end of the current calendar month if the Contractual Partner is in default of at least half of the monthly rent or if the Provider has another legitimate interest in terminating the contractual relationship.

8.4       In case of justified termination of the provider, this does not entitle the customer to any compensation. In the case of claims for damages by the provider, the statutory provisions are valid.

8.5       Should one of the above incidents occur, then the provider is entitled to replace the lock cylinder to the apartment immediately.

9.         Cancellation

9.1       A withdrawal from the reservation agreement concluded with the provider requires the written consent of the provider. If this is not done, the agreed price from the reservation agreement is also due if the customer does not make use of the contractual services. This does not apply in cases of delay in performance of the provider or an impossibility of service provision represented by him.

9.2       The contractual partner can only withdraw from the reservation agreement or cancel it without any payment or compensation claims, in case that this has been agreed in writing by a certain date. The right of withdrawal expires if it is not exercised by the agreed date, unless there is a case of default by the provider or an impossibility of providing the service for which he is responsible. The resignation must be in writing

9.3       The cancellation fees are as follows:

For cancellations up to 4 weeks before moving in: free of charge

For cancellations 3 weeks before moving in: 25% of the first month's rent

For a cancellation 2 weeks before moving in: 50% of the first month's rent

For cancellations 1 week prior to moving in: 75% of the first month's rent

For a cancellation within 1 week before moving in: 90% of the first month's rent

Cancellation fees for early departure:


Free until the 30th day before the new move-out date


From the 29th day before the new move out date 25%


From the 14th day before the new move out date 50%


From the 7th day before the new move out date 75%


From the 6th day before the new move out date 90%

The stated percentage cancellation fees always refer to the first 30 booked but unused days


9.4       The cancellation fees also apply if the provider terminates the contractual relationship on the basis of circumstances attributable to the contractual partner or the authorized user (including late payment).



10. Liability and Maintenance



10.1      There is a complete inventory list drawn up by the cleaning staff in the apartment. Damage to the inventory or the absence of listed items must be reported to the supplier without delay.

10.2      Damage incurred during the stay must also be reported to the provider immediately.

10.3      The contracting party is liable to the provider for damages caused by breach of duty.
This applies in particular to insufficient cleaning, permanent ventilation or moisture damage with the windows open, etc

10.4      The provider is not liable for damages resulting from burglary and theft.

10.5.     The contracting party is liable for damage to the terrace inventory. The care treatment e.g. Protection of the cushions against the effects of weather is mandatory.

10.6      As the leased property is a passive building, the contracting party agrees to ensure that windows are not open for permanent ventilation.

10.7      The contractor is responsible for completely closing all windows and patio doors when leaving the apartment. In the event of damage due to weather, burglary, mechanical door opening or vandalism, the contracting party is fully liable for the damage incurred. This also includes any claims for compensation by the provider.

10.8      The contractual partner is responsible for ensuring that all electrical appliances are switched off when leaving the apartment and, if necessary, disconnected from the mains (except for the refrigerator). Electronic devices brought by the contractor must comply with the latest safety standards and may be used due to general due diligence

10.9      The inventory, fixtures and decorations may not be removed from the apartment. The contracting party is liable for damages in case of infringements.

10.10    The provider is not liable for the correctness of the service description and the proper provision of the agreed services.


10.11    For all obligations arising from the terms and conditions and the reservation agreement, in 
particular the obligation to pay the costs incurred, all contracting parties are jointly and severally liable. Facts that occur in the person or behavior of one of the joint debtors work for and against all.
The contracting party is also liable for persons who, at his instigation, come into contact with the offered dwelling with his / her own will.


10.12    The penthouse apartment has to be left in the same condition as upon arrival. The contracting party is liable to the provider for damage and excessive pollution inside and outside the apartment which he or another person, who has come into contact with, at his request, with his / her own will or with the apartment offered, is responsible for.

10.13    The cost of minor maintenance work during the rental period up to an amount of € 250.00 in individual cases shall be borne by the contracting party, if it is the repair of damages that are exposed to the direct access of the contracting party or the authorized persons. The obligation to pay costs exists only up to a total annual payment i.H. v. 7.5% of the total rent (if the rental period is less than one year) or the annual rent (if the rental period is one year or longer).
Damages culpably caused by the contracting party or persons who come into contact with the offered dwelling at its instigation, with his / her own will and / or will, shall bear this in full

11. Internet

11.1      The penthouse has an internet connection (LAN and WLAN).

11.2      The provider assumes no liability in case there should not be any connection to the Internet in the event of overloading of the network or disruption of the connection. Similarly, the provider assumes no responsibility for the data transfer rate.

11.3      The contracting party must ensure that the Internet is used only within the legal framework. Punitive acts (such as illegal downloads of music or video material, etc.) are brought to light and will be prosecuted. The contractual partner alone is liable for the illegal use of the Internet connection and the costs incurred.

11.4      The provider provides only an internet connection. Devices such as laptops or similar are to be procured by the contracting party itself. Corresponding cables are to be brought along.


11.5         In the apartment is a landline telephone for normal use available.
Use is only permitted within the German fixed network. Violations will be prosecuted and billed.




12. Special Instructions


12.1     In order to ensure a reliable delivery of mail, the contracting party is requested, to provide the
correct address to mail and parcel services.




12.2         No liability for money and valuables.




12.3      Information of all kinds is given to the best of our knowledge, but without any guarantee.

12.4      For lost and found items, no liability is assumed. They are only shipped on request and at the expense of the contractor.

12.5      If a service is not provided or not in accordance with the contract and / or not customary in the traffic, the contracting party may demand rectification.


12.6      The contracting party may demand a reduction of the price corresponding to the reduced 
performance (reduction) if, after repeated request for remedy, the services are not provided or not
in accordance with the contract
. The contracting party is obligated to do everything reasonable in
the event of any disruption to service in order to remedy the under-performance and to minimize
the damage. The contracting party is in particular obliged to notify its complaints to the provider without delay
. If the contracting party does not comply with this obligation, it forfeits its claims for reduction. Subsequent complaints cannot be considered.


12.7      In the event of excessive pollution of the apartment, the provider will charge the contracting party for the cleaning costs which go beyond the normal measure. This also applies to any contamination or damage found during the monthly inspection by MAX LODGING staff.


13.       Evaluation

            The contracting party agrees that he may receive an invitation to evaluate his stay by commissioned third parties or directly from the provider


14. Jurisdiction and Applicable Law

14.1      Changes or additions to the contract, the acceptance of the application or these general terms and conditions must be made in writing. Verbal agreements, unilateral changes or additions by one of the parties involved are ineffective.

14.2      Place of fulfillment and payment is Munich, Germany.

14.3      On the contract exclusively the law of the Federal Republic of Germany is applicable.

15. Severability Clause

15.1      Should individual provisions of this contract be ineffective or impracticable or become ineffective or unenforceable after conclusion of the contract, the validity of the remainder of the rest remains unaffected.

15.2      The ineffective or unenforceable provision shall be replaced by the effective and enforceable provision whose effects come closest to the economic purpose pursued by the contracting parties with the invalid or unenforceable provision. The above provisions shall apply mutatis mutandis in the event that the contract proves to be incomplete.
